Welcome to moto4x.com (the “Website”). The Website is operated by GIGGLEPLUM PTY LTD (ACN 627 232 473), trading as Moto4x (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Website, our QR tag service, the Moto4x mobile application, and any products or services offered through the Website (collectively, the “Services”).
By using, browsing or accessing the Website, purchasing any products, activating a QR tag, scanning a QR tag, creating an account, or otherwise using any of our Services, you signify that you have read, understood and agree to be bound by these Terms. If you do not agree, you must cease use of the Services immediately.
We reserve the right to review and update these Terms at any time by updating this page. When we make material changes, we will use reasonable endeavours to notify you. Changes take effect from the date of publication. We recommend you keep a copy of these Terms for your records.
1. Definitions
- “Tag” means a physical QR code sticker or label sold under the Moto4x brand, identified by a unique 7-character activation code.
- “Owner” means a person who has purchased and activated a Tag and manages it through the owner dashboard.
- “Scanner” means any person who scans a Tag’s QR code and interacts with the resulting web page.
- “Tag Page” means the public-facing web page displayed when a Tag’s QR code is scanned.
- “Dashboard” means the owner-facing management interface at moto4x.com/my-tags.
- “Activation Code” means the unique 7-character alphanumeric code printed on or provided with each Tag.
- “Products” means physical goods listed for sale through the Website or third-party retailers, including QR tags and accessories.
- “Purchase Services” means the service of browsing and purchasing Products through the Website.
- “Member” means a registered user of the Website.
2. Eligibility
You must be at least 16 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. You may not use the Services if you are a person barred from receiving them under the laws of Australia or other countries including the country in which you are resident.
3. Account Registration and Security
3.1 Website Accounts
Certain Services require registration. As part of the registration process you may be required to provide personal information such as your email address and mailing address. You warrant that any information you provide will always be accurate, correct and up to date.
3.2 QR Tag Owner Accounts
To activate a Tag, you must provide a valid email address. This email address serves as your account identifier. Authentication is performed via magic link emails sent to your registered address. You are responsible for maintaining the security of your email account.
3.3 Account Security
You have sole responsibility for protecting the confidentiality of your password and/or email address. Use of your account by any other person may result in immediate cancellation of the Services. You agree to immediately notify us of any unauthorised use of your account or any breach of security.
3.4 One Owner per Tag
Each Tag may be activated and owned by only one Owner at a time. Transferring ownership of an activated Tag is not currently supported.
4. Moto4x QR Tag Service
4.1 Tag Activation
Each Tag must be activated using its unique Activation Code at moto4x.com/activate. Once activated, the Tag is linked to your Owner account and becomes functional (i.e., scannable by third parties).
4.2 Tag Types
During activation, you select a Tag type:
- Parking Tag: Enables Scanners to send you a message about your parked vehicle (e.g., lights left on, blocking access, minor incidents).
- For-Sale Tag: Enables Scanners to enquire about a vehicle or item you have listed for sale.
4.3 How Messaging Works
When a Scanner sends a message through your Tag Page, we deliver that message to you via email (and optionally via SMS if you have enabled SMS notifications). You may reply to the Scanner via email, and your reply will be forwarded to the Scanner through our system. Your email address and phone number are never directly revealed to Scanners. All replies are routed through our service to protect your privacy.
4.4 Tag Deactivation
You may deactivate a Tag at any time through your Dashboard. A deactivated Tag will display a notice that it is no longer active when scanned. You may reactivate a deactivated Tag at any time.
4.5 No Guarantee of Delivery
While we make reasonable efforts to deliver all messages and notifications promptly, we do not guarantee delivery of any email or SMS message. Delivery may be affected by factors outside our control, including spam filters, carrier policies, network outages and email provider restrictions.
5. Acceptable Use
5.1 Permitted Use
Access and use of the Website and Services is limited, non-transferable and allows for sole use by you for lawful, personal purposes. You agree to use the Services only for their intended purpose and in accordance with these Terms and any applicable law, regulation or generally accepted practices.
5.2 Prohibited Conduct
You agree not to:
- Use the Services for any unlawful, fraudulent, harassing, threatening, abusive or harmful purpose
- Send spam, unsolicited messages, or bulk communications through the tag messaging system
- Use Tags for phishing, scams, malware distribution or any deceptive activity
- Impersonate another person or entity when using the Services
- Submit false, misleading or offensive content in messages, tag settings or for-sale listings
- Attempt to circumvent rate limits, security measures or access controls
- Reverse engineer, decompile or attempt to extract the source code of the Services
- Use automated scripts, bots or crawlers to access or interact with the Services
- Interfere with or disrupt the integrity or performance of the Services
- Resell, redistribute or commercially exploit Tags, Activation Codes or access to the Services without our written consent
- Use the messaging system to send content that is illegal, defamatory, obscene, sexually explicit, discriminatory or that promotes violence
- Exploit the Services to harvest personal information about other users
- Collect email addresses of Members by electronic or other means for the purpose of sending unsolicited email
- Post commercial advertisements, affiliate links, or other forms of solicitation without authorisation
5.3 For-Sale Listings
If you use a For-Sale Tag, you represent and warrant that:
- You have the legal right to sell the item listed
- The listing information (including description, price and photographs) is accurate and not misleading
- You will comply with all applicable consumer protection and trade laws in your jurisdiction
We are not a party to any transaction between Owners and Scanners. The Moto4x QR tag service facilitates initial contact only. We have no liability for the outcome of any sale, negotiation or transaction.
6. Tag Suspension and Account Termination
6.1 Suspension for Abuse
We reserve the right to suspend or deactivate any Tag, without prior notice, if we reasonably believe the Tag or the Owner’s account is being used in violation of these Terms, including but not limited to:
- Sending or facilitating abusive, harassing or threatening messages
- Using Tags for spam, phishing or fraudulent purposes
- Repeatedly posting offensive, illegal or misleading content
- Circumventing rate limits or security measures
- Any use that, in our sole discretion, poses a risk to other users, the public or the integrity of the Services
6.2 Account Termination
We may terminate or permanently disable your account if:
- You have breached any provision of the Terms or intend to breach any provision
- We are required to do so by law or regulation
- We reasonably believe your account has been compromised
- You engage in conduct that is harmful to other users or to us
- The provision of Services to you is, in our opinion, no longer commercially viable
We will make reasonable efforts to notify you via your registered email address before or at the time of suspension or termination, except where immediate action is required to prevent harm.
6.3 Termination by You
You may terminate your use of the Services at any time by notifying us in writing via the ‘Contact Us’ link on our homepage or by email, and by closing any accounts you hold.
6.4 Effect of Termination
Upon suspension or termination, your Tags will be deactivated and will display a notice that they are no longer active. You will lose access to your Dashboard, message history and tag settings. We are not obligated to preserve or provide any data after termination, though we may retain data as required by law. All legal rights, obligations and liabilities that have accrued during the term shall survive termination.
7. Purchase of Products
7.1 Tag Purchase
Physical QR Tags and other Products are sold through third-party retailers (such as Amazon) or through our Website and Tag Shop. Where Products are purchased through a third-party retailer, payment is handled by that retailer and is subject to their terms of sale.
7.2 Purchase Price and Payment
By purchasing Products through the Website, you agree to pay the purchase price listed on the Website. Payment may be made through the payment gateway providers available on the Website. You warrant that you have familiarised yourself with, and agree to be bound by, the applicable terms of any payment gateway provider used.
7.3 Returns Policy
We may, at our sole discretion, provide a refund on the return of Products within 30 days where the Product packaging is unopened and remains in a saleable condition. You are liable for any postage and shipping costs associated with any refund.
7.4 QR Tag Service Fees
At present, there are no ongoing subscription fees or recurring charges for using the Moto4x QR tag service after purchasing a Tag. Basic tag activation, messaging and notifications are included at no additional cost.
7.5 Future Pricing Changes
We reserve the right to introduce subscription fees, premium features or usage-based charges in the future, including but not limited to:
- Fees for excessive or high-volume usage that significantly exceeds typical personal use
- Premium features or enhanced functionality offered as paid upgrades
- Subscription plans for Owners who manage a large number of Tags
If we introduce new fees that affect your existing Tags or account, we will provide at least 30 days’ written notice via your registered email address before the changes take effect. You may choose to deactivate your Tags and stop using the Services if you do not agree to the new pricing. Continued use of the Services after the effective date constitutes acceptance of those changes.
8. Warranty
Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of a Product. You are also entitled to have Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
You may make a warranty claim for material defects and workmanship in Products within 6 months from the date of purchase by providing proof of purchase and a description of the defect to us by email at [email protected].
Where a warranty claim is accepted, we will, at our sole discretion, either repair or replace any defective Product at no charge to you for parts or labour. You are liable for any postage or shipping costs incurred in facilitating the warranty claim.
The warranty does not apply to appearance, nor to Products that have been subjected to misuse, abnormal handling, or which have been altered or modified.
9. Delivery
We may integrate delivery through third-party delivery companies (“Delivery Service Providers”). We are not the provider of delivery services and merely facilitate your interaction with Delivery Service Providers. In the event that an item is lost or damaged in transit, please contact the Delivery Service Provider directly and notify us by email at [email protected] so we can assess the situation.
10. SMS Terms
If you opt in to receive SMS notifications through the Moto4x QR tag service, the following additional terms apply:
- SMS notifications are sent only in response to specific events (a Scanner contacting you or an Owner replying to your message). They are transactional, not promotional.
- Message frequency depends on your usage and interaction with the Services.
- Message and data rates may apply according to your mobile carrier’s plan.
- You may opt out at any time by disabling SMS in your tag settings, removing your phone number, or replying STOP to any message.

- SMS delivery is provided by Twilio. Carrier participation and delivery are not guaranteed.
- Consent to receive SMS is not a condition of purchasing any goods or services.
11. Intellectual Property and Copyright
11.1 Our Rights
The Website, the Services and all related content are subject to copyright under the laws of Australia and through international treaties. All rights (including copyright) in the site content and compilation of the Website (including text, graphics, logos, button icons, video images, audio clips, software and QR code designs) are owned or controlled by GIGGLEPLUM PTY LTD or its contributors.
Nothing you do on or in relation to the Website will transfer to you any business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright of GIGGLEPLUM PTY LTD, or the right to use or exploit any such intellectual property.
You may not, without our prior written permission, broadcast, republish, upload to a third party, transmit, post, distribute, show or play in public, adapt or change in any way any Content for any purpose, except for materials that are freely available for re-use or are in the public domain.
11.2 Your Content
You retain ownership of any content you submit through the Services (such as messages, for-sale listing descriptions and photographs). By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, display and transmit that content solely for the purpose of operating and providing the Services.
11.3 QR Code Images
QR code images generated through the Services (including downloadable branded QR code PNGs) are provided for your personal use in connection with your activated Tags. You may print and display these images freely but may not use them for purposes unrelated to the Moto4x QR tag service.
12. Privacy
We take your privacy seriously. Your use of the Services is governed by our Privacy Policy, which describes how we collect, use, store and protect your personal information. By using the Services, you consent to the practices described in our Privacy Policy.
13. General Disclaimer
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We will make every effort to ensure Products are accurately depicted on the Website; however, you acknowledge that sizes, colours and packaging may differ from what is displayed.
Nothing in these Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law, which by law may not be limited or excluded.
Subject to this clause, and to the extent permitted by law, all terms, guarantees, warranties, representations or conditions not expressly stated in these Terms are excluded, and we will not be liable for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee).
The Moto4x QR tag service is a contact facilitation service only. We are not responsible for the conduct of any Owner or Scanner, the accuracy of any for-sale listing, or the outcome of any communication, negotiation or transaction between users.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total liability arising out of or in connection with the Services or these Terms, however arising, will not exceed the most recent purchase price paid by you, or where you have not paid, the resupply of information or Services to you.
- We shall not be liable for any indirect, incidental, special, consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability, including loss of profit, loss of goodwill or any other intangible loss.
- We are not liable for any loss, damage or expense arising from the failure or delay in delivery of any email, SMS or other notification.
- We are not liable for any unauthorised access to or alteration of your data, except where caused by our wilful misconduct or gross negligence.
- We are not responsible or liable for any content posted on the Website by users or third parties.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
15. Indemnification
You agree to indemnify, defend and hold harmless GIGGLEPLUM PTY LTD, its affiliates, officers, directors, employees, agents, contributors, third-party content providers and licensors from and against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) arising from or related to:
- Your use of the Services or Website
- Any content you post or submit through the Services
- Your breach of these Terms
- Your violation of any law or the rights of any third party
- Any direct or indirect consequences of you accessing, using or transacting on the Website
16. Dispute Resolution
If a dispute arises out of or relates to these Terms, the following process applies (except where urgent interlocutory relief is sought):
- Notice: The party claiming the dispute must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle it.
- Negotiation: Within 14 days of the notice, the parties must endeavour in good faith to resolve the dispute expeditiously by negotiation or other mutually agreed means.
- Mediation: If the dispute is not resolved within 14 days, the parties must agree upon a mediator or request appointment by the President of the Australian Mediation Association. Both parties are equally liable for the mediator’s fees and the cost of the venue. The mediation will be held in Victoria, Australia.
- Termination of mediation: If 3 months have elapsed after the start of mediation and the dispute has not been resolved, either party may ask the mediator to terminate the mediation.
All communications concerning negotiations are confidential and must be treated as “without prejudice” for the purpose of applicable laws of evidence.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. Any dispute, controversy, proceeding or claim arising out of or relating to these Terms shall be governed, interpreted and construed under the laws of Victoria, Australia, without reference to conflict of law principles. The exclusive venue for resolving any dispute shall be the courts of Victoria, Australia.
The Services are intended to be viewed by residents of Australia and the United States. If you are a consumer in a jurisdiction that grants you mandatory consumer protection rights, nothing in these Terms limits or excludes those rights.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where practicable, notify you via email. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Services.
19. Severability
If any part of these Terms is found to be void or unenforceable by a court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GIGGLEPLUM PTY LTD with respect to the Services and supersede all prior agreements, understandings and communications, whether written or oral.
